On May 5, 1981, the City of Lake Station brought an eminent domain action seeking to condemn property owned by Frank Rogers. Rogers filed a counterclaim for inverse condemnation, alleging that from 1972 to 1981 the City removed sand from the property and used the land as a garbage dump and storage lot without compensating him.
